I am not sure where to post this on here, I am making a game that takes place during the early 30's and I am wanting to include some period music. Since I am going to give the game away for free, do I need to pay ascap fees even if the songs being played are no longer covered by copyright law.

Be careful of using any music, even if it's from the 30's.

In the UK:
Quote: "Copyright in a literary, dramatic, musical or artistic work lasts for the life of the author and 70 years from the end of the year in which he/she died"


and in the US:
Quote: "The duration of copyright has changed several times as Congress refined compromises over the law. Currently, [you] can generally presume that a work copyrighted less than 95 years ago is still covered by the law. ..."


Of course, the US lawmakers can't keep it simple, so there are loads of 'buts', 'excepts' and 'ifs', mostly paid for by Mr Disney and friends

Well, it would be nice to use the music as it would fit the game. Most of the artists are long since dead. I was really wanting to use the dogface soldier. Alot of sites out there just put it up for download and it says free use? I don't know.

Creative commons is also another option....That is where I get most my music from..
