Why, for your game?

If it's a fan game, I'm pretty sure you can do it nonh-commercially. Do it commercially, and you'll need a lawyer.

Even non-commercially it doesn't sound like a good idea. Work is being done on the next AAA class Duke Nukem game and I bet that the developers will protect their property!
