Hi,

I was wondering if you create an enemy which is already in a game, but create it yourself, is it allowed to be released?

Is this a riddle?

I guess if it's already in a game, then it must already be created, so you can't create it. Contact the creator to see if it can be released.

A ‘Likeness’ is any identifying characteristic which would lead the average consumer to associate that characteristic with a single person. Such characteristics can be pictures, names, and even voices.

You can be sued for copying a likeness unless it's public domain, or you have been given permission/license.

You can make a "based on xxx" model..
Like CC did with his bioshock based model..

If your model could be mistaken for a highly recognized copyrighted character, you're probably in for some problems.

Basing your original model off of something established is fine as long as you have made enough changes so that it looks unique.

Here's an extremely exagerated example: I base a new model on Spiderman. My model better not resemble Spiderman in texture or physicality when I'm done. If anyone can look at my model and say, "Hey, that's Spiderman.", I've got problems.

I've seen your work so far. I like what you're doing. I can't wait to see what you come up with, in the way of a character.

Well I've been working on milkshape for a while now and was going to make a model pack related to a game...but after seeing this I will change my models and textures and not release them in a pack
