Yes. It's not actually certified by Windows (I'm guessing) and it wasn't actually rated by the ESRB. (I'm guessing.)

You must be wary on those things.

My suggestion is to finish a game before looking around for what your DVD case is going to look like.

Most people don't even finish a game, and most finished games don't ever make it in a DVD case.

Take it one step at a time. Start with the game.

Correct. Xplosys has pretty much said it all already. You can't have an ESRB rating on a commercial box cover that hasn't been rated by the ESRB. And as Metal Devil has pointed out, you're also using a copyrighted image that belongs to CAPCOM (Resident Evil), which is also illegal without permission from the original artist/copyright holder.

You can look into TIGRS. It's free, but it doesn't carry the same recognition as an ESRB rating. But as Bullshock mentioned, before you invest all of this time working on the cover for your game, you need to finish the actual game first. A game cover is designed around the game, not the other way around.

Ontopic: You should make the game first. THEN make the cover art. If you get there, then maybe you can get it rated by the ESRB.

But as Bond1 would tell you, the ESRB is one nasty bunch. I'd stay away if I were you.
