Typical, i spend an eternity searching for an answer to my copyright issue, then stumble accross this which may answer a few questions of others.
I wanted to know if these terms apply to fps creator or any others such as fps creator x10? also i assume i can use any of the assets/objects on the model packs without any copyright issues?
This was copied from F&Q section on one of your pages, my main concern is that the copyright and infringement side of things, to someone who is thinking of making a game for sale, is about the most important aspect there is, i think it definatley needs to be addressed.

FAQ - Copyright and Licenses
1.Q: What copyright issues will there be with games I make?
A: In a nutshell - none! You are able to save EXE files without any restrictions or water-marks / splash screens. These can be given away for free, or sold. There are no commercial restrictions on the sale. If you make a killer game and earn thousands from it you don't owe us a penny. You can sell the games on your own web site, or you can sell them to a publisher, it's up to you. Please keep us informed though, we'd love to hear about it!


2.Q: Does the "no royalty" license include games created by modifying the game engine source code you've released?
A: Yes. There is only one restriction regarding the game engine source code - and that is you cannot use it to create another "Game Making" type of application. But other than that, you can do whatever you like.


3.Q: Will you sell my game for me?
A: Sorry, but no. We will be happy to publicise your game in our monthly newsletter and on our web site, but we're not a games publisher.

It's my understanding that these terms apply to FPSCreator. FPS Creator X10 has different terms, but I was not able to find them either. I just remember a discussion on it a while back.

Its my understanding that games you create using FPSC and stock media which comes with it have no restrictions but the model packs have a different license, I could be wrong here but believe you have to contact the original creator to inform them when you intend to use these in a commercial game, I dont think there are any further fees attached to this but its part of the EULA for certain official model packs and certain items purchased from the store I am not even sure if it only applies to certain creators. Its actually all a bit hazy to me really but you would have to read the license from each product to be sure. I might be confused but as long as there is no license displayed along with the product on official TGC model packs who the heck knows where ya stand.
It should actually be made much clearer what each license is for any product displayed on that products page before purchase, not something you find in a folder after download or have to scour the website looking for it. Same goes for each item from the store, it wouldn't take much for the seller to do this for their product, nor would it be difficult for TGC to display it prominently on each of their product pages.

If you look at the very bottom of the fpsc (x9) manual you will see somewhere saying you should put thegamecreators in the documentations which means you can put it in the manual or the commercial lisence that you made for your game.

Also, I believe all model packs are under a no restriction commercial policy as well, but I could be wrong.

Look up one directory from Files, so go up to FPS Creator, and you will see a folder called licenses. (Imagine that)
Look in there for the various model licenses from items purchsed through the TGC store.
I'm pretty sure the model packs are licensed the same as the stock media included with FPSC.

X10 commercial license is $1,000 for relasing games (1 time fee for unlimited # of releases), but you don't have to pay it until you have grossed $5,000 from your game(s).

I think the media can be used in any game release, so the licenses for the engine used would be the difference here between X10 and X9.
However, if I grossed $5,000 or more from a game that I used X10 assets in, then I would pay TGC the $1,000 for the X10 license whether I used another engine or not.
That is only a one time fee that is only due after you have earned more than enough to pay it. (then you could use the assets anytime for any project without worries)
