In this scene we`re trying to achieve where player walks on the roof while rain is falling the radio nearby switches on and ``Hey You`` from Pink Floyd starts playing.
So the question is, can we use Music in this non-commercial project, which wont be published, (only given download link on the forum)

Are you an Abba fan?

Short answer is yes you can use it, but only for private use. You cannot distribute the music with your game - you can't even give it to your friends.

In some way yes, I love their music.

So if I post a download link of my game (that has a piece of someone`s music in it) Thats Illegal?
I know Jonez used the sound from penumbra in Phobia.
(Which is by the way one of the good fpsc games)
So I believe as long I dont make profit of game which has some music in it, and not publish it, just share it with you guys so you can judge it. I HOPE I WONT BE SUED??

I wouldn't be so sure.

You can't use published music without permission. It's as simple as that. Putting a song in a game and distributing it regardless of whether any money is made is as illegal as file sharing. If it wasn't then there would be a massive loop-hole for the music thieves.

It depends on the country you live in and on copyrights law applicable. In many countries short parts of songs (up to 30 seconds) are treated as "reference to" and not as "giving away other mans property to others".

Well I`m not going to put whole songs just a small-time pieces with static. But how Jonez managed to pull that off without being sued by Frictional`s???

Personally, I put commercial music I legally own in my games all the time. However, my games are only shared with my friends. I have no intentions of ever releasing a commercial game. If I did I probably wouldn't be using FPSC, but, that's another story..Anyway, If you're like me, this is just a fun hobby, and when you are building a game, "commercial," and "licenses," and all that jazz are the furthest thing from your mind.

I just want t create something my friends and family will enjoy.


It could be wrong...but, I don't think it is worth worrying about 'getting sued' over simply adding a song or part of a song into a free and private game. I guess it just boils down to your conviction level. I just don't see anything wrong with it.

The ones doing the damage are the ones who release the commercial music for free for the sole purpose of releasing it for free.

A user would have to decrypt the game just to strip out a 'crappy' .WAV version of a song they could just have easily had pirated..

Doesn't make much sense to me why anyone (Court) would care..Anyway, that's my pov.
