At some point this year my project will split into two branches.

1) the current Windows version based on dbpro.

2) a linux\mac c++ opengl conversion.

so my question is am I allowed to use the game assets from the model packs in a non TGC based game, for commercial purposes?

I'm pretty sure you are. When you buy the model packs, you buy the rights to use them in any product, no matter what language. Exceptions would be redistributing them as some form of model pack yourself.
