That's a bit worrying. If I was the photographer who took them or one of the models... (yeah I know I'm not that pretty) and saw you promoting your game (even though it is free) I would be looking for compensation. Unless they are published as free to use for commercial use that is.

Even a free game is considered commercial use, particularly if you are advertising in the app (which you are).

Be careful.

I'd argue that such laws do exist in China (and have for several decades), but see what you're saying... The issues can be especially murky when selling an app internationally where IP is rigorously defended. Even to release an app on the iTunes market you must agree to the terms of service that you own the rights to all intellectual property etc. Of course, I doubt all the celebrity photo apps saturating the market have had the photo rights secured!

Halley,
it is very funny that people in this forum talks about owners' right about something made in China! We all know that you are very good at copying (in a very good way) all kind of European and Italian stuff.
Also for tecnology Huawey is conquering Telco equipment market, and they started by copying Cisco.
BTW, I recognize that you are very good to do original thing, but everyone in this world has to start with something, and you, like Japanese, started by copying. Maybe in the future we western people will have to copy from you, as we did in the past when the China Empire of the Big Wall, together with India, has been the incubator of many discoveries and inventions.
So I do not think you have to be worried to take some photo of beautiful oriental models (that, if they are on the Internet, they want to expose themselves) and use for an innocent game.

Marco, I wonder how you would feel if someone took one of your games and sold it without your permission. I imagine you would feel like you deserved a share right?

What Halley is doing here may or may not be legal in China but he is selling it on iTunes and Apple may take a different stance and decide to pull his game or even all of his games.

I have no problem with a little creative re-use under certain circumstances but I also appreciate that IP is something becoming less and less important.

I want Halley to do well, I've put some work into his games myself. If those games get pulled because of a "small" issue of IP then it would be a real shame. Not at all funny really.

It's easy to joke about intellectual property when it isn't yours being taken.

I find that very hard to believe. Even if they don't exist in China they do exist in other countries. If the owner(s) of the photos decide to claim copyright in any of the countries, that have enforceable copyright laws, where that app is available; it will probably get pulled off the app store.

Hi,
As far as I know, Apple has more restrictive policies than Google, especially on sexual materials, so if they allow to publish the app with the models, Apple thinks there this is not pornography or IP issues.
Otherwise if Apple began to retire all apps only because someone has got some claims on some music, image or other media used for an app, I think that all virtual markets would be closed in a few days, and we all return to the times of the markets with people crying in the city center also for software.
The question is not if Halley obtained permission from the models (of course not...), but why Apple granted the publication.
In general I think that for each little media we use, we have to ask permissions to the world, it is better to change the hobby or work, or to go to work for Nintendo or big sw factories where they have a big library of media to work with (Mario, Wario, Donkey Kong, etc) or great art and music designers.

Marco, I think you are missing the point. If the owners complained to Apple then Apple would be obliged to pull the app or face a legal battle. Whether you like it or not people can and do own the things they create. You don't have to ask permission for everything, just for the things that people don't allow you to use for commercial use. It's very easy to find out what can and can't be used commercially from the sites we download from with very little effort. Blindly using anything and everything we want to use from the internet is not a given right, nor should it be. If I create something that I want people to pay for then I expect them to pay for it, if I make something people can use for free I tell them they can use it for free.

It's a responsibility to ourselves that we do everything within our power to check the intended use of the media in the first place.

The virtual markets would not close, they would be less full of copied, low grade entertainment but the general quality of apps would in fact be better because it would encourage more creativity.

I don't care whether you find it ridiculous but I do care that other people don't dismiss it as easily because of your comments.

- I tell you that you cannot continue repeating people the same IP issues, when, to say the truth, and we can witness it, the earnings with the apps are RIDICOLOUS, unless you are "angry bird". I have not yet seen a layer calling you for 10€ earnt by copying some picture or music.
- the statements on the quality of the apps based on the original media can be discussed, because it is not enough to have a good media to do a good game. A lot of games with excellent graphics or music, are unplayable, boring or stupid. I approved your position during the "Gekko war" (who is Italian as me, so it was not easy for me to go against him), but one thing is to take a breakout game and call it ArknOld, another thing is to take a free screensaver and use as background. I do not think that this has negative approach on the app quality. I think that quality can be even better if I find some media better that mine.
- Since we are in an international contest, to set up an international cause, let's say a USA or European media owner try to send to court a Chinese or Indian, or vice-versa (and even UK vs USA or UK vs Italy), I see very expensive and risky, especially for little amount of money, and if the media owner is not a giant.
- Of course if I copy Nintendo Super-Mario, everything of evil may happen to me , but only because Super-Mario is a very precious resource for Nintendo, it is like I steal the Crown Jewels from the Tower of London only to sell at 1$ each one at the market. I will be pursued by all MI5 and Scotland Yard not because I want to earn much, but because I robbed a extremely valuable resource, the flagship of the United Kingdom. So Mario, Kirby and others are the "family jewels".

I'm not angry, not at all. I don't let things get to me like a lot of people, I just wanted to point out that you are making it sound like people's creativity means nothing. If enough people say something people start to believe it.

Practically it is unlikely that anyone will get into any kind of legal battle you are right. Does that make it OK to just take someone's work and use it without asking when they clearly say it is not for commercial use?

I have no idea if that is what Halley has done with this game and I'm sorry to Halley for filling this thread with this discussion. I will stop now. I think we have both made our points clearly enough and without any malice.

I hope you don't think I was angry with you Marco, I really wasn't

I guess the site where Halley got the pictures, got them somewhere else without permission also, and if he ask them for permission, they will claim they own the pictures, and demand compensation...

Maybe Halley should change the game, and use booth babe pictures, taken by himself on any random IT-trade fair
