This case is as stupid as the one when microsoft sued this kids web site because the domain name sounded like microsoft when pronounced.

You're probably thinking of Mike Rowe Soft, but I don't think Microsoft won the case, I think they ended up giving him a decent payoff to change his domain instead.

Incredible really. So what, if you make a dynamic game that allows the players to alter just about anything they want (ie. a decent game), even using their own materials (eg. textures) then you are going to get in trouble? Erm. Heh, can just imagine coding in all superheros so that it doesn't happen again. So you would end up with basically the options to create Grey man (power to make things grey), and perhaps Potato peeler boy (power to peel potatos). Erm. Basically there is a million heroes out there, and they pretty much cover everything neat.... my God!!!! SuperDaz is really strong! Just like the Hulk! Take the f**ker to court!!!!!!

And then every patch would basically make the game smaller, with players being thrown off because they were too similar to brand new comic creations. Hmmm.... can this work the other way around? So a character I create in COH (say Potato peeler boy) first, can be used to take Marvel to court for creating the same character in a comic later?

It's just an example of a big company wanting to get a bit of the action from another (smaller) company. Maybe they should get off their a**se and make a half decent game themselves. Jealous w**kers...

Grrr, makes me mad.... they won't like me when I get mad TM (Doh!!!!)

I think it's because the Marvel execs are kicking themselves because they didn't think of the idea first

ugh.. sounds to me like the makers did it intentionally.. when's the last time you had an idea about making a 'super strong hero' and instantly thought green

Look at "Street Fighter's" Zangief character.. he's as 'hulk' as they come, but he's not a mimic of the hulk in any other way than being big

Look at Blanka, he's green, but in any other way he's not the hulk..

These are unique characters that do pretty much the same as marvel's character's but they are not the same..

Looks to me like this company wanted to let players mimic marvel's creations, rather than letting players modify the hero's abilities and choosing different mannerisms for their characters...

Actually when you create a hero in City of Heroes, you can apparently adjust just about everything imagineable. What the author of that quote was trying to say is that you can make a hero look like a licensed comic book hero by adjusting many things. It would be IMPOSSIBLE to remove likenesses from COH unless you got rid of the ability to be green, and the ability to be big, etc. Know what I mean?

From what I took from the quote I posted above, was the fact that you can make them green and muscular and move like the hulk in one fell swoop.. Which I could imagine being construed as making it easily possible to make the hulk, and a feature of the game.

I've never played the game, so I don't know.

I wonder what'd happen if someone ends up playing a Marvel MMORPG (if they make one) and makes a "Statesman" character...will COH sue Marvel, then?

Not really. Nothing stops anyone from suing anybody for any reason. It would be a bad sign if Marvel actually won, however.

I played that game once, I made a dwarf wolverine! Since when did Marvel have patents on imaginary powers? Image comics have a character that looks exactly like wolverine, just different colors. And almost every comic company has its own version of Hulk. Cmon, get real Marvell. Just because your daredevil movie sucked balls, dont go around looking for other ways to make up the money.

umm!! their Spiderman character did rather well at the box office though iirc, can you be sued for making a green large superhero called superbogieman though? , I doubt this case would last 2 minutes in court, more like good pre Christmas publicity for COH (remember .. there is no publicity but good publicity).
