Valve Hammer 3.4(3.5) RMF file importer for 3DS Max has been released at http://www.accode.com.
Now you can load RMF files directly to 3DS MAX with textures, lights, entites, groups...

Does Valve Hammer 3.4's license allow this?

Valve Hammer 3.4 has been released under GPL license. So you can use it for free. RMF importer allow you to use levels created in Hammer in commercial products.

(If I'am correct, which I think I am) The application is GPL, however the format and its usage are still patented.

Plus; The Hammer has been released under a Mozilla style GPL, which, assuming the above is incorrect, the format is now owned by those in control of the GPL'd version. If that is aslo true; you are in breach of licencing by selling this as a separate product

Yeah, although it make me shudder to do this. I agree with David R.
You can't retail you RMF Plug-In.

Not to be funny but I'm not so keen on seeing such a capitalist attitude within a Hobbiest forum.

If Hammer can still save to a .map (I don't know as I stopped using it), then I would make an importer for that. I believe the .map format is still free.

.MAP is only free if your using it for a Quake-Based Licensed Engine. .BSP however is free, provided you release the source to your importer.
