Hi, I've got a question that's been on my mind recently. If I sell a game with the "real world" weapons in it, can I get sued? Or, is it legal to sell the game with these weapons in it?

Interesting question.

Not knowing the answer directly, I went and did some research, and pretty much uncovered nothing concerning the appearance of a specific weapon, in any media context, that infringes on existing copyright. That isn't to say such a law doesn't exist, but if it does, they're certainly not advertising.

I suspect the answer is that it is legal. My reasoning being, in all the reference books I own on firearms, not one lists acknowledgements of trademarks for the various weapon manufacturers: something that would certainly be required if the printing of a weapon image was copywritten by a weapon designer or manufacturer.

I think that a more likely scenario is that certain mechanics of a weapon would be patented, rather than the design in its entirity:but this would not extend to a copyright infringement if you produce a three-dimensional model of a firearm.

Nice question, though, Turtle Torte. Hope someone perhaps with industry knowledge responds to this, as it would be interesting to know.
