I don't see Nintendo going after Mario Forever, and how are Nintendo going to shut me down? I'd love to know, as they'd likely never get my email address or any other contact details. They could contact me on my forum, but then their messages would encounter a strange case of data corruption once they were printed, framed and tacked to the wall.

I'll wear my C&D with pride if ever it comes knocking. Which I don't think it ever will. If it does come, I'll negotiate. Surely I can alter it to a degree that they're happy? After all, they don't own the entire platform fighting industry. I could even call it a big piece of fan art. How often do fan art creators get C&Ded?

Nintendo is extremely lenient on fan games, you'll be fine. I mean heck, there's a forum for people making Zelda fan games, and Nintendo hasn't done anything about that. Also, there are probably more Mario fan games on the Internet than any other game.

Small sidenote, the fact that they don't sue others doesn't mean they won't sue you. I think you're safe, though.
