doubt it... but you can always email the BBC and ask permission to use it, usually they'll say yes - especially if its a non-profit project.

Besides, you made the model yourself. Although it looks like a darlek, I'm sure that you won't be exterminated Exterminated EXTERMINATED if you do lol.

Just email them and ask. You made it yourself, the project is not commercial, they probably wont care

Finish with...

"Due to the time restraints involved, I will assume that there is no issue unless I hear otherwise from you. However, confirmation by return would be appreciated."

Then, the Onus is on them to reply to you in a timely fashion, and you have covered yourself in the event on no reply.

In most cases you will not get sued for using a copy-written object without permission (on a non commercial/freeware release). With that said, you may be asked to remove it from the web or stop any distribution.
Examples of this are some Disney sites, and a wonderful half life Pokemon Mod, that was later changed to Pokemod because they were pressured that Pokemon was a copy-written name. It finally just disappeared, because I am guessing that they were threated with a law suit, because Pokemon was so hot then. Any half-life people know what finally happened with Pokemod?

Ok, not to start another America vs England thread, but WTF is a darlek or drlek, depending on which post above you read, anyway? I figure it's a british thing because of the reference to the BBC. Hmmm, it looks like an angry salt shaker to me.

You're not serious are you? Where the hell did you hear that LOL?

Mind you, the seventh series of Stargate SG-1 starts this Monday on Sky One!!!!!! God I look forward to that! I love the programme, since the film, I was so intreagued by the idea that basically, something like this could happen. Hell you don't know what the Gov.. holds back. Wormhole theory, gravitons, theoretical partical physics based on the throery of latent plasto mechanical molecular changes using plasma driven surface stretch compositions? Anyway, where'd I put that syringe....

perfectly serious
msn.co.uk had news of it yesterday when it was announced, the BBC site has more info somewhere.
i certainly hope they try to make it on par with the likes of Stargate quality wise - most UK programs just don't have that little sense of being "fake" about them, ya know what i mean?
like spooks, its cool but its shot in such a way that next to the american ones it seems far too real.

that aside i think your gonna love the new SG-1 series
it only just started up again here, certainly some interesting plot twists already - i love the whole continuation of sperate episodes yet all part of a bigger storyline thing going on

AHAHAHHAHHHHHHA
im an American and have seen every episode of Dr Who!!! My parents got me hooked when i was a lil' kid. Started buying the episodes on DVD but DAMN! they are expensive. Last year went to London to do some rave'n, at about 2am a DJ dropped a hard tech track with the Dr Who theme song remixed in... WOOHOO! IMHO, Dr Who is the 2nd best TV show to date, beaten only by the Sopranos, with simpsons a close 3rd.
And he didnt travel back in time, he traveled through time! any way he wanted, and jumping dimensions along the way. hehe

okay, sorry, ill settle down now

Well this thread is chock full of bad advice.

No matter what you say in an email, copyright holders are under no onligation to tell you NOT to use their Intellectual Property. Quite the opposite, in fact. You are obliged to get permission to use it.

All the comments about not-for-profit are erroneous too. You can still be sued on a freeware project. Moreover, it makes absolutely no difference ( legally ) whether you are or are not making money.

In order to sue you, the BBC would need to prove loss of earnings, not that you had made earnings. It wouldn't be hard to prove, if they chose to do so, though I've no personal experience with dealing with the BBC in regards to IP, so I can't possibly comment as to whether they would take action.

At the very least, they could demand you remove it, which would be a bit of a shame. If you email them and ask them first, it's quite likely they'll say yes.

But just going ahead and using it without permission is a) illegal and b) likely to annoy them enough to not let you use it whereas they otherwise might.

Well sir, if you are any of the following say so:
1. A BBC broadcaster/representative
2. An Attorney
3. An uptight brit
4. A Luthuanian
5. A terrorist
6. An Anti-Marxist
7. Dr. Robotnik
8. Dr. Who's arch enemy

I'd be very interested in knowing

Just get your lawyer(ya have one right?) to write a letter asking about the copyrights,if you don't have one,go to the 'Justice Palace' or whatever it's called and from there you can easily buy/treat for copyright,I know I will when it comes time to using music(planning on buying rights on classical stuff such as Rossini and Wagner)

Also here is a model from polycount that has been downloaded hundreds of times, so if you get sued you will be one of many.

Also remember the retro competition many of the entries including mine contained "Knock offs" and I heard of no law suits.

exactly... you make nothing, they're not loosing a penny. And unless the game is actually Dr Who themed they can't prove that it would take away potential customers for thier merchandise - especially as you need to prove that over 10,000 poeple or more are using the said program to be able to claim that it is a wise enough audience to hurt sales.

put bluntly, its only the petty as hell american companies that will do anything about the copyrights.
Just look at Bid For Power, Toei Studios own the copyrights to DBZ ... but as Funimation have the US Rights, they shut down the BFP team - Toei Studios knew about the mod ... they apparently even backed the mod, but as the rights were Funimations - sadly an online game was shut down (until they thoughtof a craft way around it)

BFP was still released, it still has the DBZ character... all funimation did was piss everyone off involved.
But quite frankly if an amature group makes a game so good that it threatens your sales then quite frankly you need better developers rather than shutting down the amatures

Just stick it in your game, it's not a problem for the BBC. If you were making a movie then it would be a problem.

Most of that comment is misleading. Freeware can get sued if you cause people loss of earnings, mainly by copying another game though.
