So I have fallout 3 disc and everything but the disk got damage and won't work. Would it be legal to download a torrent of the game since I do own it?

No, especially since you would essentially be sharing it with others while downloading.

I don't want to advocate illegal activity but in my opinion it's okay to bend the rules when it makes the most sense. After all, they have their money but you don't have your product - it's nobody's fault, but it seems to me the law cares more when companies lose money than when you lose it. It's up to you but I make a point to not obey laws that don't work. But in the end of the day it's not about right or wrong, it's about the law, so that's your call.

If you buy a house and blow it up by leaving your gas on and accidentally lighting a match, you don't get to steal a new house. The same thinking applies here, which is why it would still be illegal. They sold you a working product, you broke it, they don't owe you another working product unless the damage was their fault and they've agreed to cover damages caused by them, IE a warranty.

I imagine this thread will be locked pretty soon as it conflicts with the AUP so I thought I would get my two cents in.

Why would this thread be locked? It's questioning the laws thats all. Is there a way to hide your ip when downloading a torrent?

There's no way to hide your IP for anything without a middle-man.

This question comes up at least once a month. What you do with this situation is your choice and your responsible for your actions. Bottom line, it's illegal.

Besides, you can buy a Fallout3/Oblivion Battle Chest for 20 bucks at the store, that's two games and six expansion packs.
