Hello there.

I'm about to release my game Flow Motion (finally). Since it's my first finished project I want to keep it free (also, I doubt anybody would seriously consider paying money for this ). However, I know almost nothing about legal issues.

For instance, most games seem to come with an installer that, apart from installing the game obviously, requires you to accept certain terms of use. Is something like that necessary, or at least recommended? Like to make sure the player doesn't sue you when his graphics card explodes while playing your game?

Websites usually require an about page including name, adress and contact information of whoever is responsible. Is there something similar for video games? Do you need Credits of some sort?
On top of that my game contains an interactive link to my website (i.e. you can click on it and it will open the site in your browser), might there be a problem with that? Most websites seem to explicitly state that they're not responsible for the content of any outgoing links. Would I need to include such a disclaimer into my game?

Sorry if all this seems a little random, just a few concerns I've had in mind for the last couple of days. I'm not really sure how to google this stuff, searching for "things to know before releasing a game" doesn't exactly yield many results. And since we're talking about the release of a free game, I didn't exactly intend to get a lawyer.

I kind of doubt that there are any actual, strict laws on this stuff, considering that there are probably thousands of free games coming out each day, and I haven't heard of anybody getting sued for not having a proper credits screen in the game. But you never know...

If someone's gonna sue you, they'll do it with the page full of disclaimers or not. Just a one-liner disclaimer laying the expectations out clearly to the user is enough for a small claims judge to roll his eyes at the claimant.

That said, I'm no lawyer so of course go consult one before taking someone on the internet's advice.

Also, your game looks freaking awesome, you should polish it (particularly the UI) and charge for it. My two cents.

Sounds like you want a GNU General Public License. It allows your software to be distributed freely, prevents others from claiming ownership of your code (using it in proprietary software) and removes your liability for any damages caused by the program, or a modified version of it.

Also, you can still charge for your game and still release it under the GNU GPL (in case you're on the fence on charging)!

Just adding in, be sure to include your legal documentation READ ME FIRST [as often seen], file in the same directory, and make one at least an RTF [Rich Text Format] file and if you wish a Word Document or PDF version as well...

Nothing wrong with thinking about this, but those GNU's I need more experience with them before I say anything about them...

I'm not sure though whether the GNU GPL is the best option for me since I actually didn't plan to release the source code. Not because there's anything "secret" inside - I just don't like the idea of random people judging my coding style.

Thank you for the compliment bitJericho but selling it probably wouldn't work out that well. Maybe for a dollar or so, but even for free it's tough enough to get people to play it, so I'll just keep it free and work on a few more appealing games in the future.

I seem to recall that under GPL, you don't actually have to publish your code, you just have to give it to anyone who asks for it (you have to give the version of the code that is for the published binaries).

Don't take my word for it!, look it up and find out

just to chirp in here but if you are going to make a READ ME FIRST or disclaimer document try not to make it a Word or rtf as not many people will have Word installed, best to make it either a plain text document or pdf.

I reject your reality and substitute my own...

You might find people are more apt to play your game if you charge. People sometimes don't find value in free things.
